Lessor’s defence for defective disclosure restored to the Retail Shop Leases Act

Queensland Parliament have now passed the Court and Civil Legislation Amendment Bill 2017 on 23 May 2017. The Bill restores the lessor’s defence for defective disclosure to the Retail Shop Leases Act 1994. Once the Bill receives assent (expected in the next few weeks), the provision containing the lessor’s defence will take effect from 25 November 2016 so that there is no ‘gap’ in the lessor’s ability to rely on this defence.
