De facto De facto

De facto

What is a de facto relationship?

It is generally accepted that a de facto relationship arises where two individuals of either same sex or different sex cohabit together on a genuine domestic basis in a relationship based on trust, intimacy and personal commitment to each other.

The Family Law Act 1975 applies to parties in a de facto relationship including in relation to their children. Please see our pages regarding property settlements spousal maintenance and childrens' disputes for more information or our recent article " Am I in a de facto relationship ?"
Couples can enter into cohabitation or fiancial agreements dealing with property and financial issues before they move in together.
